Help Responding to Partner Visa Department Requests
A partner visa request for information starts with the Department’s letter and deadline. Check each requested item or concern before preparing your response.

Read the letter and check the deadline
Start with the complete notice, including any attachments. Before gathering more documents:
- Preserve the letter and the message through which it arrived.
- Identify the application, applicant and visa stage concerned.
- List every requested document, question or concern separately.
- Record the response deadline and any instructions for calculating it.
- Note the submission channel and any document-format instructions.
The actual notice determines what you need to address, how to respond and when, subject to the statutory scope of sections 56–57 of the Migration Act. Do not assume a response period from another applicant’s experience applies to your letter.
Keep the broader partner-visa application context clear: which stage is being assessed, whose information is requested, and what evidence has already been submitted? An applicant’s document request and a sponsor’s document request should not be treated as interchangeable. For a Brisbane couple, identifying those details is more useful than starting another general application checklist.
Is it a section 56 request or a section 57 invitation?
A request for further documents and an invitation to comment on adverse information serve different purposes. Read the wording of the notice against sections 56–57, rather than classifying it only by its subject line.
| Notice type | Purpose | Response focus |
|---|---|---|
| Section 56 request | Seeking additional information relevant to the application. | Address each requested item, provide the relevant information and identify anything outstanding. |
| Section 57 invitation | Inviting comment on specified adverse information within the section’s statutory scope. | Address the identified information or concern directly, explain your position and connect it to supporting records. |
Not every document request is a section 57 invitation. Nor should section 57 be treated as a requirement that every unfavourable fact must be put to an applicant through that procedure. If the notice’s legal basis or scope is unclear, an Australian migration lawyer can assess it before a response is drafted.
Match each issue to an explanation and evidence
For a partner visa response, create one row for each issue in the letter. Separate documents already available from those still being obtained. The following matrix is illustrative—not a checklist of requirements for every couple.
| Issue in the letter | Explanation needed | Supporting evidence | Outstanding item | Proposed next step |
|---|---|---|---|---|
| Gap in the relationship chronology | What happened during the identified period, using truthful dates. | Relevant correspondence, travel or household records already held, if they support the explanation. | Any relevant records still being retrieved. | Draft the explanation and identify which record supports each key date. |
| Sponsor’s Australian police certificate requested | Whether the requested certificate is available or still being obtained. | Complete-disclosure AFP certificate, if available; otherwise any existing application acknowledgement. | Certificate awaiting issue, if applicable. | Check the certificate type and follow the letter’s submission instructions. |
| Document needs an English translation | Identify the original document and its language. | Original document and compliant English translation, when available. | Translation not yet completed. | Arrange translation and record whether its completion date is estimated or confirmed. |
| Adverse-information concern | Your response to the precise information identified in the notice. | Relevant records supporting that response. | Any material needed to address a specific point. | Prepare a point-by-point response; seek legal assessment if the concern is unclear. |
For chronology questions, connect a truthful account of the relationship’s development and significant events to relevant records, following the 309 relationship-document guidance. Do not create dates or events to fill a gap.
If the request concerns the sponsor’s Australian police certificate, the 820 sponsor checklist specifies a complete-disclosure AFP National Police Certificate, not a state or territory certificate or standard disclosure.
For translations, Home Affairs requests the original and English translation. Australian translators require NAATI accreditation; overseas translators must identify their contact details, qualifications and experience under the document guidance.
Before submission, compare the draft with the letter and your earlier application material. Explain genuine discrepancies rather than silently changing the account. Mark missing evidence openly, and do not substitute an unrelated document simply to fill a row.
Check extension instructions and possible consequences
An extension request needs reasons and must use the designated channel described in the Partner visa FAQs. Asking for more time does not mean it has been granted or that the original deadline has stopped running.
Check the letter for:
- The response deadline and submission method.
- Instructions for requesting additional time.
- Any stated consequences of not responding or providing incomplete information.
- Whether the Department has confirmed a different deadline after an extension request.
Consequences need to be assessed against the actual notice and applicable law under sections 56–57. Neither automatic refusal for every late response nor protection from refusal merely because some documents were supplied should be assumed. An Australian migration lawyer can interpret unclear instructions and assess the response options.
Responding to a pending Department request is different from dealing with an actual partner visa refusal. If a refusal has already occurred, start with the decision letter: it explains the reasons and whether review is available, as outlined in the 801 decision guidance. That is a separate decision stage, not simply another information request.
What if the evidence cannot be supplied on time?
Prepare an explanation rather than leaving the outstanding item unaddressed:
- Identify exactly which requested item is unavailable.
- Explain why it cannot be supplied within the requested period.
- Retain any existing proof of attempts to obtain it, such as an application acknowledgement or provider correspondence.
- State the expected availability date, distinguishing an estimate from a confirmed date.
- Request extra time before the deadline through the designated channel, and retain a copy of the request.
The Partner visa FAQs explain response-extension instructions. An extension is not automatic: continue treating the original deadline as operative unless a change is confirmed. If health examinations are outstanding, Home Affairs says to notify it through ImmiAccount when the requested timeframe cannot be met, under its health-examination instructions.
Enquire with an Australian migration lawyer about preparing your partner visa response. Identify the visa stage, letter date, response deadline and broad issue so the lawyer can interpret the notice, assess the concern, identify relevant evidence, prepare the response and frame any extension request. Questions about this step
Does a request for information mean my partner visa has been refused?
No. A request or invitation under sections 56–57 of the Migration Act is distinct from a refusal decision. Check whether you have received a request to respond or an actual decision letter.
Can I use the same response deadline as someone else?
Do not rely on another applicant’s deadline. Your notice determines the response requirements and deadline within the scope of sections 56–57. Check its wording and any subsequent confirmation from the Department.
Should I wait until every document is ready before asking for more time?
If an item cannot be obtained on time, explain what is outstanding and request extra time before the deadline through the designated channel. Follow the Partner visa FAQs, and do not assume the request suspends the original deadline.
