Partner visa rules are federal. Queensland civil-partnership registration can be relevant to a qualifying de facto relationship, but it does not establish visa eligibility on its own.

The registry’s 10-day cooling-off period is not a guaranteed certificate-delivery time. Check the Queensland registration instructions before arranging an application.

Which partner visa pathway fits your circumstances?

The temporary and permanent 820/801 stages are applied for together in Australia. The 309/100 pathway requires the applicant to be outside Australia at application, as does subclass 300. Application location differs from decision location: Home Affairs permits 820, 309 and 300 decisions in or outside Australia under those respective guides.

The sponsor ordinarily must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen, and sponsorship requires approval under Home Affairs sponsor guidance. A Brisbane address alone is insufficient. Restrictive conditions, uncertain status or previous refusals need individual assessment before choosing a route.

Onshore offshore and fiancé application help

Onshore: 820 and 801

An Australian migration lawyer can check application validity, current visa conditions and relationship documents before lodgement. The 820 eligibility guidance includes requirements that need particular attention where the applicant lacks a substantive visa.

Offshore: 309 and 100

For an applicant outside Australia, a lawyer can assess the pathway, check sponsor information and identify missing supporting documents against the 309 application guidance.

Prospective marriage: subclass 300

A lawyer can assess the intended marriage pathway and plan the later partner application. Subclass 300 requires an adult applicant, an eligible prospective-spouse sponsor, an in-person meeting as adults and an intention to marry within the visa period. It is not permanent residence; after marrying, couples wishing to settle should apply for 820/801 before the 300 expires.

What evidence and sponsorship work is needed?

A Brisbane partner visa application involves separate applicant and sponsor tasks.

Explain financial arrangements, household arrangements, social recognition and commitment. Establish sponsor status and examine previous sponsorship history.
Build a truthful chronology and connect it to relevant documents. Check applicable restrictions, relevant criminal history and police documents.

The four relationship aspects come from regulations 1.09A and 1.15A. The cited compilation must be read with the commenced 2 October 2026 amendment, which does not amend these partner provisions. Documents should reflect actual circumstances, consistent with the 309 relationship checklist. A marriage certificate does not replace the genuine, continuing relationship requirements in section 5F.

Sponsor eligibility and restrictions require their own assessment under Home Affairs sponsor guidance. The 820 sponsor checklist specifies complete-disclosure AFP and applicable overseas police certificates. A lawyer can identify evidence gaps, check consistency and assess sponsorship restrictions.

How do Queensland registration and Brisbane access fit in?

Under Queensland civil-partnership rules, both partners must be adults, at least one must live in Queensland, neither may already be married or in a civil partnership, and prohibited family relationships are excluded.

Qualifying registration can remove the usual 12-month de facto duration requirement under regulation 2.03A, read with the amendment noted above. Other exceptions include compelling and compassionate circumstances and specified humanitarian cases. Registration does not remove the genuine-relationship tests in section 5CB.

The Queensland registration guidance provides appointment submission at the government registry, Level 32, 180 Ann Street, Brisbane. Its non-shortenable 10-day cooling-off period is not a certificate-delivery guarantee. This is local registry access—not a separate Brisbane visa eligibility test or this guide’s office.

What help is needed for complex cases and decisions?

  • Status or conditions: Have a lawyer distinguish application validity from grant criteria. For certain applicants without a substantive visa, 820 guidance requires special recent Commonwealth statutory declarations; Form 888 does not satisfy that requirement. Schedule 3 grant criteria are a separate issue. A No Further Stay waiver request does not itself waive the condition or extend a visa.
  • Department request: Preserve the notice and identify its requested response, channel and deadline. Under the partner visa FAQ, extra time must be requested; do not assume an extension.
  • Relationship change: Separation or bereavement requires assessment of notification and possible continuation pathways. 801 guidance identifies qualified exceptions, not automatic continuation.
  • Family violence: Prioritise immediate safety. Use a safe email or account the former sponsor cannot access, following the official partner procedure. Do not send detailed violence evidence through a general enquiry. A lawyer can assess the specific family-violence provisions; they do not guarantee permanent residence.
  • Refusal or review: Preserve the letter, notification details and current visa information. A lawyer can check review entitlement and deadlines. ART migration time limits cannot be extended. Merits review differs from court review for jurisdictional error, which does not reassess whether a visa should be granted.

Questions about this step

Does the two-year point mean the permanent visa will be granted then?

No. Under 801 guidance, assessment eligibility generally starts two years after the combined application, not the 820 grant. Earlier assessment may apply to qualifying long-term relationships. Eligibility for assessment is not a guaranteed grant or decision date.

Does sponsor withdrawal automatically cancel a partner visa?

No automatic cancellation should be assumed. The partner visa FAQ distinguishes withdrawal of sponsorship from the applicant withdrawing the visa application. The consequences and any continuation pathway need individual assessment.

Can an applicant travel overseas after lodging in Brisbane?

Do not assume lodgement makes travel safe. Check the current visa and actual bridging grant. Home Affairs travel guidance identifies the Bridging visa B travel period as permission to leave and return while awaiting a substantive decision; other bridging visas do not provide that return permission.
