Partner Visa Evidence and Document Checklist for Brisbane Couples
A partner visa document checklist should separate applicant records, sponsor records and relationship evidence. For Brisbane couples, the documents depend on the visa pathway and the couple’s circumstances.

What documents does the applicant need?
Start with the visa pathway, then use its Home Affairs checklist—not a single list presented as complete for everyone. The 309 applicant checklist covers identity, relationship, character and relevant family documents.
Organise separate folders for:
- Identity: passport, identity records and relevant name-change documents.
- Relationship: evidence and written accounts of the relationship.
- Character: Australian AFP and overseas police certificates according to residence history, relevant military records and other requested information. Under the 309 character guidance, police certificates are generally valid for immigration purposes for 12 months; fresh certificates may be requested.
- Included children: identity, family relationship, dependency and parental-responsibility evidence. For a child under 18, a non-migrating person entitled to decide their residence may need Form 1229 or applicable legal evidence, as explained in the family-document checklist.
The onshore 820/801 stages are applied for together. Subclass 300 has its own evidence requirements, including intention to marry and having met in person as adults, under the prospective marriage guidance.
For preparation, Home Affairs instructs applicants to upload clear colour scans, combine each multi-page document into one file, and provide English translations alongside originals. Australian translators require NAATI accreditation; overseas translators must identify their contact details, qualifications and experience. The visa checklist does not generally require certification.

What documents does the sponsor need?
Keep sponsor documents separate from applicant records. Include identity and evidence of Australian citizenship, Australian permanent residence or eligible New Zealand citizenship. Brisbane residence alone is insufficient, and sponsorship requires approval under the Home Affairs sponsor guidance.
Record previous sponsorships, any history of being sponsored as a partner, and relevant criminal-history information. The subclass 300 sponsor guidance identifies restrictions that require assessment beyond checking status documents.
For police documents, the 820 sponsor checklist specifies:
- a complete-disclosure AFP National Police Certificate, not a state or territory certificate or standard disclosure;
- overseas certificates for each country where the sponsor spent 12 months in total during the last 10 years since turning 16;
- consent to disclosure of convictions for relevant offences.
These sponsor checks are distinct from the applicant’s residence-history-based character documents.

Which evidence covers the four relationship aspects?
Partner-visa relationship evidence is organised around financial arrangements, household arrangements, social recognition and commitment. The framework appears in regulations 1.09A and 1.15A, read with the commenced amendment, which does not amend those provisions.
Applicant, sponsor and relationship evidence matrix
The examples below are possibilities, not a mandatory universal list. Use the Home Affairs relationship checklist and your actual circumstances to select relevant material. Complete the last two columns with your own dates and questions.
| Person or relationship aspect | Documents to consider | What the documents help establish | Dates or periods covered | Missing information or inconsistencies |
|---|---|---|---|---|
| Applicant | Identity, police and relevant family records | Identity, character and family circumstances | Issue dates; residence periods | Name differences; missing records |
| Sponsor | Identity, eligible-status evidence, sponsorship history and police records | Status and matters affecting sponsorship | Status dates; history periods | Unclear status or incomplete history |
| Financial arrangements | Shared bills, bank records or shared financial responsibilities | How finances are managed | Actual statement periods | Explain separate finances or uncovered periods |
| Household arrangements | Lease, household bills or accounts of domestic responsibilities | Where and how the household operates | Addresses and occupancy dates | Address differences or absent records |
| Social recognition | Invitations, photographs and supporting witness statements | How others know the relationship | Events and witness knowledge periods | Unclear dates or limited personal knowledge |
| Commitment | Correspondence, shared plans and relationship accounts | Continuing commitment and future intentions | Development and plans over time | Conflicting milestones or unexplained gaps |
There is no universal photo quota or compulsory joint-account rule in this framework. A marriage certificate also does not replace the genuine, continuing relationship requirements in section 5F.
Queensland registration: qualifying registration can remove the general 12-month de facto duration requirement, but not the genuine-relationship tests. Regulation 2.03A, read with the amendment above, also preserves compelling and compassionate and specified humanitarian exceptions.
Registry paperwork is separate from visa evidence. Queensland’s registration instructions require identity documents and witnessed declarations, with certified copies for postal applications. Use an official registration certificate, not a commemorative one. The registry offers appointment submission at Level 32, 180 Ann Street, Brisbane; this is government access, not a different federal visa rule.
How do relationship statements and witness documents fit?
Statements explain the significance of documents rather than simply listing attachments. The 309 relationship checklist asks for written details of relationship development, living arrangements, engagement or marriage, shared activities, significant events and future plans.
| Document | Its role |
|---|---|
| Applicant and sponsor relationship accounts | Explain the couple’s own history and arrangements |
| Form 888 supporting statement | Adds an adult witness’s personal knowledge of both people and their relationship |
| Special validity declaration | Serves a separate lodgement requirement in specified 820 circumstances |
For the couple’s chronology, identify key dates, connect events to available records and explain genuine gaps. Do not invent a model relationship or hide differences in recollection. A Form 888 statement supports social relationship evidence; it does not replace the couple’s own evidence.
When is Form 888 different from a statutory declaration?
The supplied Form 888, design date 08/26, requires identity evidence, a signature and a date. It has no authorised-witness execution block. The writer must be at least 18 and know both people and their relationship history; citizenship or permanent-residence evidence is requested where applicable, not required of every writer.
| Point | Current Form 888 | Special 820 validity declarations |
|---|---|---|
| Purpose | Supporting social relationship evidence | Required documents for eligible applicants without a substantive visa |
| Writer | Adult with the required personal knowledge | Australian citizen, permanent resident or eligible New Zealand citizen |
| Timing and form | Follow the current form, checklist and individual requests | At least two Commonwealth statutory declarations made within the preceding six weeks |
Under the 820 validity guidance, those eligible applicants must also provide online sponsorship, sponsor-status evidence and declaration-makers’ status evidence. The declarations confirm the married or de facto relationship.
Neither current nor previous Form 888 versions satisfy this special declaration requirement. Missing required documents at lodgement risks invalidity. Application validity must be checked separately from whether the applicant meets the criteria for a visa grant.
How can gaps and contradictions be reviewed?
Review the partner-visa matrix against the actual chronology, applicable checklist and any Department request:
- Mark periods with little or no supporting material.
- Compare names, addresses and dates across records and statements.
- Record genuine explanations for differences without altering facts to make documents agree.
- Identify unsuitable document types, including Form 888 used where special validity declarations are required.
If Home Affairs requests information, preserve the notice and check the documents, response channel and deadline. The Partner visa FAQ explains how to request extra time; do not assume an extension is granted or the original deadline stops running.
An Australian migration lawyer can assess document suitability, identify gaps, check application-validity requirements and advise how to explain genuine inconsistencies. This review cannot promise validity or approval.
For an optional partner-visa evidence-review enquiry to an Australian migration lawyer, state the pathway, application stage, broad evidence concern and any Department deadline—not a complete sensitive evidence bundle. Partner Visa Brisbane is an information and lawyer-enquiry guide, not a law firm.

Questions about this step
How should I record evidence that covers several relationship aspects?
List the document once, then note each fact and period it supports. For example, a shared household bill may be relevant to both household and financial arrangements. Explain its relevance rather than duplicating it to increase document volume.
Should I leave a gap blank until I find more evidence?
Record the missing period and what remains uncertain. Separate an unavailable document from an unexplained relationship fact, then identify any truthful explanation or question for legal review.
What should I prepare for an initial evidence-review enquiry?
Provide a short summary of the visa pathway, application stage, broad document concern and any stated Department deadline. Keep detailed records available for a later review rather than sending passports or a sensitive evidence bundle through a general enquiry.
