Partner Visa Review Help: ART and Court Options
A partner visa refusal may be reviewable by the Administrative Review Tribunal (ART), or need assessment for court review. For Brisbane applicants, start with the decision notice to check who can apply, the available pathway and the deadline.

ART merits review or court review: what is the difference?
ART merits review and judicial review address different questions. The ART immigration review guidance explains that the Tribunal reviews some migration decisions—not every partner visa refusal. The Federal Circuit and Family Court of Australia applicant overview explains that Division 2 reviews certain decisions for jurisdictional error, rather than deciding afresh whether a person should receive a visa.
| ART merits review | Judicial review in court |
|---|---|
| Concerns the merits of a migration decision that is reviewable by the ART. | Concerns whether a decision is affected by jurisdictional error. |
| Reviewability and the person entitled to apply must be checked against the decision notice and applicable rules. | The decision, court jurisdiction and proposed legal grounds require assessment. |
| Preparation focuses on the refusal reasons, relevant criteria, evidence and submissions. | Preparation focuses on an arguable legal error in the decision-making process, not simply presenting a stronger relationship case. |
| Migration review time limits vary, and the ART cannot extend them. | The court overview states a 35-day filing period from the decision date; an extension can be requested with reasons. |
| It is a merits-review process, not a guaranteed visa outcome. | The court cannot grant a visa. A successful case can return the matter to the decision-maker. |
These distinctions follow the ART guidance and court overview. They are not interchangeable options, and both should not be assumed available in every case.
Understanding the partner visa refusal reasons comes before choosing the review task. Broader refusal preparation concerns the original decision; this page focuses on preparing an available review or assessing court-review scope.
Who can apply, and what deadline applies?
Home Affairs says the refusal letter explains the reasons and whether review is available in its 801 decision guidance. Preserve the complete notice rather than relying on a summary or screenshot of the outcome.
For an initial legal assessment, identify:
- The visa subclass, decision and refusal reasons.
- The decision date and how and when notification occurred.
- The person the notice identifies as entitled to apply for review.
- Any stated deadline and filing instructions.
- Current visa status, relevant grant notices and any detention circumstances.
ART deadline: The eligible review applicant is not necessarily the visa applicant, particularly in offshore matters. Deadlines vary by decision and detention status, and the ART cannot extend migration review time limits, according to its immigration review guidance. Do not assume a universal 28-day period or that either partner can lodge.
Court deadline: The court applicant overview states 35 days from the migration decision date, which may differ from the notification date. An extension can be requested in the application with reasons, but whether it is available and granted needs individual assessment.
If a deadline may be close, make that clear at the start of an enquiry. Contacting a lawyer or this guide does not lodge a review or meet a filing deadline.
Prepare the review evidence and hearing
For a partner visa merits review, organise preparation around the actual refusal reasons—not a generic document bundle. Begin with the decision notice and review pathway described in the Home Affairs decision guidance and ART guidance.
Tasks to discuss with an Australian migration lawyer include:
- Identify disputed criteria. Separate the findings that led to refusal from background information that did not determine the outcome.
- Organise the record. Assemble the lodged application, supporting material, departmental requests, responses and later correspondence for the lawyer's assessment.
- Assess relevant evidence. Identify what addresses each disputed finding, including any genuine gaps or inconsistencies that need explanation.
- Prepare submissions. Connect the applicable criteria, evidence and requested outcome rather than simply adding more documents.
- Prepare for any scheduled hearing. Discuss the issues likely to require explanation and the Tribunal's actual instructions. Do not assume every case has a hearing or a standard format.
Where relationship findings are disputed, prepare a truthful chronology with supporting material. The official partner relationship checklist requests details about relationship development, living arrangements, significant events and future plans. It is a preparation aid, not a guarantee that a refusal will be resolved.
A marriage certificate does not replace the genuine, continuing relationship requirements in section 5F of the Migration Act. De facto relationships have separate requirements under section 5CB of the same Act.
Brisbane access and relationship registration
Local relationship-registration arrangements and federal partner visa review are different matters. The Queensland civil partnership rules set registry eligibility; they do not determine the review of a federal visa decision. Queensland registration and Brisbane access information can provide local background for relationship-evidence preparation, but registration should not be treated as automatically repairing a refusal.
Court review: limits, costs and visa status
Disagreement with a relationship finding is not, by itself, an assessment of jurisdictional error. An Australian migration lawyer can examine the decision and record for a possible legal ground, explain the court's scope and assess whether proceedings are available. The court applicant overview confirms that the court cannot grant a visa; a successful case may return the matter to the decision-maker.
Before proceeding, clarify costs and status separately:
- ART fee: The ART immigration review guidance, checked on 9 October 2026, lists AUD3,727 for most migration reviews. Reductions, refunds and exceptions depend on the case. Confirm the current fee before filing.
- Court and professional costs: Ask for a written scope and quote covering legal assessment, filing and representation. Ask which court charges apply and what potential costs exposure needs consideration. No verified court charge or Brisbane professional-fee range is supplied here.
- Visa conditions: Court filing does not itself confer a visa or work or travel permission, according to the court overview. Current status and conditions need separate assessment.
- Medicare: Services Australia permits enrolment during ART appeal with the specified valid-visa and appeal documents. Judicial review alone does not establish Australian-resident Medicare eligibility, although other coverage grounds may apply.
Partner Visa Brisbane is an information and lawyer-enquiry guide, not a law firm. Enquire with an Australian migration lawyer about preparing an available partner visa merits review or assessing court review scope. Start with the decision notice, notification details, current visa status and any approaching deadline; ask for confirmation of who can apply, the filing deadline and a written scope and quote. An enquiry is not a review application.

Questions about this step
Can my partner lodge the ART review instead of me?
Possibly, but entitlement must be checked rather than assumed. The ART immigration review guidance explains that the decision letter identifies who can apply; in offshore matters, this may differ from the visa applicant. Being the sponsor does not by itself answer the review-standing question.
Can the ART review a No Further Stay waiver refusal?
Home Affairs states that the ART cannot review its No Further Stay waiver decision in the waiver guidance. That is separate from whether a later partner visa refusal is reviewable. A further waiver request requires substantially different new circumstances.
What if I discover that the ART deadline has already passed?
The ART says it cannot extend migration review time limits. Ask an Australian migration lawyer to check the decision, notification and applicable deadline promptly. Do not assume court review replaces a missed merits review: court jurisdiction, legal grounds and its own filing period require separate assessment under the court guidance.
